Terms & Conditions
§ 1 Scope
(1) The following General Terms and Conditions (GTC), in the version valid at the time of the order, apply exclusively to all contracts for the provision of transport services and the escrow service between JZ Transporte GmbH, Bachstraße 9, 33154 Salzkotten, Deustchland (hereinafter "Forwarder") and its customers (hereinafter "Customer").
(2) Any deviating, conflicting or supplementary general terms and conditions of the Customer shall only become part of the contract if and to the extent that the Forwarder has expressly agreed to their application in writing.
§ 2 Conclusion of contract
(1) The presentation of our transport and escrow services on the website does not constitute a legally binding offer but an invitation to submit an enquiry.
(2) By sending a transport enquiry via the contact form, the Customer makes a binding request for a quotation. The Forwarder then prepares an individual offer which the Customer can accept by written confirmation (e.g. by email). The contract is concluded upon acceptance.
§ 3 Scope of services
(1) The Forwarder provides transport services for agricultural and construction machinery, vehicles, trailers, classic cars, caravans, motorhomes as well as special and heavy cargo, both nationally and throughout Europe.
(2) Via the escrow service, the Forwarder acts as an independent third party in the purchase processing between buyer and seller. The specific services are described in the individual contract.
§ 4 Prices and payment
(1) Agreed prices are in Euro plus the applicable statutory value added tax.
(2) Invoices are due for payment within 14 days of the invoice date without deduction, unless otherwise individually agreed.
(3) In the case of escrow processing, the buyer pays the purchase price into the Forwarder's escrow account. Payment to the seller is made in accordance with the contractually agreed conditions, at the latest after the buyer's 14-day inspection period has expired.
§ 5 Delivery and transport
(1) Unless otherwise agreed, the Forwarder determines at its reasonable discretion the type of transport and the choice of vehicle and route.
(2) Transport times are approximate. Delays due to force majeure, traffic disruptions, official orders or comparable circumstances do not give rise to claims by the Customer.
(3) The Customer is obliged to prepare the goods properly and have them ready for collection at the agreed time.
§ 6 Warranty and liability
(1) The Forwarder's liability is governed by the provisions of the Allgemeine Deutsche Spediteurbedingungen (ADSp — General German Forwarder Conditions) in the version applicable at the time, unless otherwise stipulated in these GTC.
(2) Liability for slight negligence is limited to the breach of essential contractual obligations and, in terms of amount, to the damage typically foreseeable under the contract. Any further liability for slight negligence is excluded.
(3) The above limitations of liability do not apply in the case of injury to life, body or health, or in the case of intent and gross negligence.
§ 7 Right of withdrawal for consumers
In the case of distance selling contracts, consumers generally have a statutory right of withdrawal, about which the Forwarder informs separately in accordance with the statutory templates. The right of withdrawal does not apply to contracts for the provision of services if the Forwarder has fully provided the service and has only begun performing the service after the consumer has given express consent and has confirmed knowledge that the right of withdrawal will be lost upon complete performance of the contract by the Forwarder.
§ 8 Data protection
The Forwarder processes the Customer's personal data in the context of the contractual relationship. Details can be found in our Privacy Policy.
§ 9 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction for all disputes arising from the contractual relationship shall be the Forwarder's registered office — provided that the Customer is a merchant, a legal entity under public law or a special fund under public law.
(3) Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
